With the use of Services, you expressly agree to the use of your medical record for aforesaid purposes.
You have complete freedom of choice regarding submission of your health information on the Website. You can choose not to submit your health information, in which case customized advice regarding your health condition will not be available on the Website.
Our web servers automatically identify your computer’s connection to the Internet, including your IP address when you visit our site. (The IP address is a number that lets the computers attached to the internet know where to send the data such as the web pages you view.) The IP however doesn’t identify you personally. It is usually in the form of aggregated statistics on traffic to various pages within our site and all information will be stripped of personal information so that it cannot be recompiled and individual users cannot be identified. 3.1 Registrierung von Benutzerkonten
Für die Nutzung der digitalen Physiotherapie- und Rehabilitations-Plattform ist die Erstellung eines Benutzerkontos durch eine vorherige Registrierung erforderlich. Diese Inhalte sind ausschließlich Nutzern zugänglich, die einen entsprechenden Vertrag mit uns abgeschlossen haben, der zum Zugang zu diesen Bereichen berechtigt. Bei der Registrierung müssen Sie u. a. Ihren Namen, Ihre E-Mail-Adresse, Ihre Telefonnummer sowie ein Passwort angeben.
Wir verarbeiten und speichern die bei der Registrierung zur Verfügung gestellten personenbezogenen Daten ausschließlich dazu, um Ihnen den Zugang und die Nutzung der Webseite zu ermöglichen. Rechtsgrundlage für die Verarbeitung Ihrer personenbezogenen Daten ist Art. 6 Abs. 1 lit. b), Art. 9 Abs. 2 lit. a DSGVO DS-GVO.
3.2 Kontaktanfragen
Bei Anfragen über unser Kontaktformular ist u. a. die Angabe Ihres Namens, Ihrer Anschrift, Ihrer E-Mail-Adresse, Ihrer Telefonnummer, Ihres Kontaktaufnahmegrundes sowie Ihrer Nachricht erforderlich.
Wir verarbeiten und speichern die bei der Kontaktanfrage zur Verfügung gestellten personenbezogenen Daten ausschließlich dazu, um Ihre Anfrage zu bearbeiten, zu beantworten und uns mit Ihnen in Verbindung zu setzen.
Rechtsgrundlage für die Verarbeitung Ihrer personenbezogenen Daten ist die Erfüllung unserer vertraglichen Pflichten (Art. 6 Abs. 1 lit. b) DS-GVO) bzw. die Wahrung unserer berechtigten Interessen, die insbesondere darin bestehen, mit Ihnen in Kontakt zu treten und zu den jeweils betreffenden Anliegen, zu denen Sie uns kontaktiert haben, zu kommunizieren (Art. 6 Abs. 1 lit. f) DS-GVO).
3.3 Newsletter
Bei der Anmeldung zu unserem Newsletter-Service ist u. a. die Angabe Ihres Namens, Ihrer E-Mail-Adresse und Ihrer Postanschrift erforderlich.
Soweit Sie uns bei Anmeldung zum Newsletter-Service Ihre Einwilligung in die Datenverarbeitung erteilt haben, verarbeiten und speichern wir die bei der Newsletter-Anmeldung zur Verfügung gestellten personenbezogenen Daten ausschließlich dazu, um den Newsletter-Service bereitzustellen und Sie entsprechend des jeweils abonnierten Newsletter-Services über Veranstaltungen, Produkte, Services und/oder Werbeaktionen von Prehab zu informieren.
Sofern Sie bei der Newsletter-Anmeldung darin eingewilligt haben, können wir außerdem Ihr Nutzerverhalten beim Öffnen des betreffenden Newsletters analysieren und die dabei erhobenen Daten für die Personalisierung zukünftiger Newsletter und anderer werblicher Kommunikation verarbeiten.
Rechtsgrundlage für die Verarbeitung Ihrer personenbezogenen Daten ist Ihre Einwilligung (Art. 6 Abs. 1 lit. a) DSGVO).

3.4 Bestellungen und Dienstleistungen

4. Cookies und ähnliche Technologien
Abgesehen von zwingend notwendigen Cookies wie in Ziffer 3 beschrieben setzen wir keine Cookies und ähnlicher Technologien auf unserer Webseite ein.
5. Weitergabe personenbezogener Daten
Prehab wird Ihre personenbezogenen Daten nicht an Dritte weitergeben oder anderweitig verbreiten, es sei denn, dies ist für die Erfüllung unserer Dienstleistungen erforderlich (Rechtsgrundlage der Verarbeitung: Art. 6 Abs. 1 lit. b) DSGVO), Sie haben in die Weitergabe – z. B. an andere Prehab-Konzerngesellschaften – eingewilligt (Rechtsgrundlage der Verarbeitung: Art. 6 Abs. 1 lit. a) DSGVO) oder die Weitergabe von Daten ist aufgrund einschlägiger gesetzlicher Bestimmungen zulässig.
Prehab ist dazu berechtigt, im Rahmen der datenschutzrechtlichen Vorgaben die Verarbeitung Ihrer personenbezogenen Daten ganz oder teilweise an externe Dienstleister auszulagern, die für Prehab als Auftragsverarbeiter gem. Art. 4 Nr. 8 DSGVO tätig sind. Externe Dienstleister unterstützen uns z. B. bei dem technischen Betrieb und Support der Webseite, dem Datenmanagement, der Bereitstellung und Erbringung von Dienstleistungen, dem Marketing und der Webseiten-Analyse. Die von Prehab beauftragten Dienstleister verarbeiten Ihre Daten dabei ausschließlich gemäß unseren Weisungen. Prehab bleibt dabei für den Schutz Ihrer Daten verantwortlich, der durch strenge vertragliche Regelungen, technische und organisatorische Maßnahmen und ergänzende Kontrollen durch uns sichergestellt wird.
Personenbezogene Daten können außerdem auf sonstige Weise verarbeitet und auch gegenüber Dritten offengelegt werden, falls wir dazu gesetzlich – z.B. durch gerichtliche Verfügung oder zur Erfüllung rechtlicher Pflichten – verpflichtet sind (Rechtsgrundlage der Verarbeitung: Art. 6 Abs. 1 lit. c) DS-GVO).
6. Datenübermittlungen in Drittstaaten
Für den Fall, dass die Empfänger Ihrer personenbezogenen Daten ihren Sitz außerhalb der Europäischen Union oder dem Vertragsabkommen über den Europäischen Wirtschaftsraum (sog. Drittstaat) haben, ergreift Prehab, falls erforderlich, geeignete Garantien nach Maßgabe der gesetzlichen und aufsichtsbehördlichen Vorgaben, um die Sicherheit Ihrer personenbezogenen Daten im Rahmen der Verarbeitung durch einen im Drittstaat ansässigen Empfänger zu gewährleisten.

7. Speicherdauer
Ihre personenbezogenen Daten werden von uns nur solange gespeichert, wie diese für die Erreichung der Zwecke, für die diese Daten erhoben wurden, erforderlich sind oder – soweit darüber hinaus gehende gesetzliche Aufbewahrungsfristen bestehen (z. B. im Handelsgesetzbuch und in der Abgabenordnung) – für die Dauer der gesetzlich vorgegebenen Aufbewahrung. Im Anschluss werden Ihre personenbezogenen Daten von uns gelöscht. Lediglich in wenigen Ausnahmenfällen können Ihre Daten auch darüber hinaus gespeichert werden, wenn z. B. die Speicherung im Zusammenhang mit der Durchsetzung und Abwehr von Rechtsansprüchen zugunsten von Prehab erforderlich ist.
8. Ihre Datenschutzrechte
Nach Maßgabe des geltenden Datenschutzrechts stehen Ihnen insbesondere gemäß den gesetzlichen Voraussetzungen die folgenden Rechte zu:
- Recht auf Auskunft, Berichtigung, Löschung und Einschränkung: Sie haben das Recht, jederzeit Auskunft über Ihre von uns gespeicherten personenbezogenen Daten zu verlangen. Wenn wir Ihre personenbezogenen Daten verarbeiten oder nutzen, bemühen wir uns, durch angemessene Maßnahmen sicherzustellen, dass Ihre personenbezogenen Daten für die Zwecke, für die sie erfasst wurden, richtig und aktuell sind. Für den Fall, dass Ihre personenbezogenen Daten unrichtig oder unvollständig sind, können Sie die Berichtigung dieser Daten verlangen. Ferner haben Sie ggf. das Recht, die Löschung bzw. Einschränkung der Verarbeitung ihrer personenbezogenen Daten zu verlangen, wenn z. B. für eine solche Verarbeitung gemäß dieser Datenschutzerklärung oder geltendem Recht kein legitimer Geschäftszweck mehr besteht und gesetzliche Aufbewahrungspflichten die weitere Speicherung nicht erfordern.

- Recht zum Widerruf Ihrer erteilten Einwilligung: Sofern Sie in die Erhebung, Verarbeitung und Nutzung Ihrer personenbezogenen Daten eingewilligt haben, können Sie Ihre Einwilligung jederzeit mit Wirkung für die Zukunft widerrufen, jedoch ohne dass die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf erfolgten Verarbeitung dadurch berührt wird.
- Widerspruchsrecht gemäß Art. 21 Abs. 1 und 2 DS-GVO: Sie haben das Recht, aus Gründen, die sich aus ihrer besonderen Situation ergeben, jederzeit Widerspruch gegen die Verarbeitung Ihrer personenbezogenen Daten, die aufgrund von Art. 6 Abs. 1 lit. e) oder f) DS-GVO erfolgt, einzulegen. Wir verarbeiten Ihre personenbezogenen Daten nach einem Widerspruch nicht, es sei denn, wir können zwingende schutzwürdige Gründe für die Verarbeitung nachweisen, die Ihre Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen (vgl. Art. 21 Abs. 1 DSGVO, sog. „eingeschränktes Widerspruchsrecht“). In diesem Fall müssen Sie für den Widerspruch Gründe darlegen, die sich aus Ihrer besonderen Situation ergeben.
- Ferner haben Sie jederzeit das Recht, auch ohne Angabe von Gründen der Verarbeitung Ihrer personenbezogenen Daten für die Zwecke der Direktwerbung zu widersprechen.

Außerdem haben Sie das Recht, sich bei der zuständigen Aufsichtsbehörde zu beschweren, wenn Sie der Ansicht sind, dass die Verarbeitung Ihrer personenbezogenen Daten nicht rechtmäßig erfolgt. 9. Sicherheit und Vertraulichkeit
Um die Sicherheit und Vertraulichkeit der von uns auf der Webseite erfassten personenbezogenen Daten zu gewährleisten, nutzen wir Datennetzwerke, die unter anderem durch branchenübliche Firewalls und Passwortsysteme geschützt werden. Beim Umgang mit Ihren personenbezogenen Daten ergreifen wir angemessene technische und organisatorische Maßnahmen, um Ihre Daten vor Verlust, Missbrauch, unbefugtem Zugriff, Offenlegung, Abänderung oder Zerstörung zu schützen und die Verfügbarkeit zu gewährleisten.
10. Persönliche Informationen und Kinder
Die meisten der auf dieser Webseite verfügbaren Serviceangebote richten sich an Menschen ab 18 Jahren. Jede Person, die Informationen über ein Arzneimittel anfordert, das für die Anwendung bei Kindern zugelassen ist, muss das 18. Lebensjahr vollendet haben. Wir werden nicht wissentlich personenbezogene Daten von Minderjährigen unter 18 Jahren sammeln, verwenden oder weitergeben, ohne vorher die Zustimmung eines Erziehungsberechtigten (z. B. eines Elternteils oder Vormunds) durch direkten Offline-Kontakt eingeholt zu haben. Der Erziehungsberechtigte erhält (i) Informationen über die konkrete Art der personenbezogenen Daten, die von dem Minderjährigen erhoben werden, (ii) für welchen Zweck diese Verwendet werden und (iii) die Möglichkeit, jeder weiteren Erhebung, Nutzung oder Speicherung solcher Informationen zu Zusatz
